Products / Acetylene Tank Fire
Plaintiff was a plumber who suffered 3rd degree burns when an acetylene tank caused a fire while brazing copper pipe. Plaintiff was an independent contractor and brought a claim against the plumbing company for negligence and negligence per se based on violations of safety and the plumbing code. Despite the independent contractor status and significant disputes regarding causation, Plaintiff confidentially resolved the claim against the plumbing company.
Tread Separation Rollover / Death and Injuries
While returning from the airport picking up his family who had been in New York attending a ballet school, the Toyota 4 Runner equipped with Cooper tires suffered a tread separation, rollover and roof crush. The vehicle had been purchased two (2) days prior to the incident. Claims were made in Harris County District Court for the death and injuries to the surviving spouse and child. Confidential settlements were achieved against the dealership and Cooper tire for the tread separation and Toyota for the roof crush.
Product Liability / Television Fire
A nine (9) year old child was burned over 68% of his body when a Sanyo television caught his home on fire. Suit was filed in Washington County District Court against Sanyo and Walmart for product defects including allegations that a 25 cent piece of equipment would have prevented the fire. A confidential settlement was reached which provided for future medical needs of the child.
Product Liability / Split Tire Rim Explosion
An elderly woman was severely injured when airing up a tire on a dolly resulting in the rims separating and striking her body. The tire was installed on a split rim without any warnings and/or safety mechanisms. Suit was brought in Galveston County District Court against the distributor, Taiwanese intermediary and Chinese manufacturer. The case was settled which included the proper reporting to the Consumer Product Safety Commission.
Benzene Exposure
A refinery employee in Texas City , Texas contracted multiple myeloma, which his doctors determined was caused by exposure to benzene at work. Despite law prohibiting suits by living employees against their employers, the firm was able to negotiate a settlement on behalf of the injured worker while he was still alive. This allowed the injured worker to fight his fatal disease knowing that his family would be financially secure after his death.
